New PCT International Fees for Sept 1 2010

Please be advised of the following development just released from the USPTO:
The International Bureau of the World Intellectual Property Organization has informed the United States Patent and Trademark Office that due to changes in the exchange rate of the U.S. dollar with regard to the Swiss franc, the dollar amounts of certain fees for international applications filed in the United States Receiving Office have been changed, effective September 1, 2010.
The amount of these fees will be:
International filing fee (for first 30 pages of the international application) – $1147
International filing fee (first 30 pages – filed in paper with PCT-EASY file on diskette, CD-R or DVD-R or filed electronically without PCT-EASY zip file) – $1061
International filing fee (first 30 pages – filed electronically with PCT-EASY zip file) – $974
Supplemental fee for each additional page over 30 – $13

PCT-PPH Pilot with KIPO

The PCT-Patent Prosecution Highway in Conjunction With the Korean Intellectual Property Office
Under the PCT-Patent Prosecution Highway, an applicant receiving a written opinion or an international preliminary examination report from either the Korean Intellectual Property Office (KIPO) or the USPTO that at least one claim in a PCT application has novelty, inventive step, and industrial applicability may request that the other office fast track the examination of corresponding claims in corresponding applications. The PCT-Patent Prosecution Highway will leverage fast-track patent examination procedures already available in both offices to allow applicants in both countries to obtain corresponding patents faster and more efficiently.
As of May 25, 2010, the USPTO has eliminated the fee for the petition to make special under the PPH programs.
The trial period starts on 01 June 2010 and is set to expire 31 May 2012, but may be extended for additional time or terminated earlier depending on volume of activity and other factors. Both offices will provide notice of any adjustment in the pilot program.

PCT-Patent Prosecution Highway (PPH) Between USPTO and JPO (Pilot)
Under the PCT-Patent Prosecution Highway, an applicant receiving a written opinion or an international preliminary examination report from either the Japan Patent Office (JPO) or the USPTO that at least one claim in a PCT application has novelty, inventive step, and industrial applicability may request that the other office fast track the examination of corresponding claims in corresponding applications. The PCT-Patent Prosecution Highway will leverage fast-track patent examination procedures already available in both offices to allow applicants in both countries to obtain corresponding patents faster and more efficiently.
The trial period starts on 29 January 2010 and is set to expire 28 January 2012, but may be extended for additional time or terminated earlier depending on volume of activity and other factors. Both offices will provide notice of any adjustment in the pilot program.

PCT SAFE Issues (Jan 2010 Release)

Please be advised of the following:
The newest version of PCT- SAFE/EASY (version 3.51.044.220 – 1/1/2010) and EFS-Web are currently experiencing the following issues:
- When the EFS-Web box in PCT-SAFE/EASY is checked, a valid PCT-SAFE/EASY zip file will be generated for uploading in EFS-Web
- However, PCT-SAFE/EASY will NOT allow the user to “save as ready for submission” until there is an S-signature
- If the EFS-Web box is NOT checked, PCT-SAFE/EASY allows “save as ready for submission” without the signature, but the PCT-SAFE/EASY zip file created will fail EFS-Web validation with a non-embedded font error
The International Bureau and USPTO are currently in the process of resolving these issues.
